MEETING MINUTES – March 20, 2012

CALL TO ORDER

Melissa Kelly, Chair, called to order the regular meeting of the Lancaster Township Planning Commission at 7:00 pm on March 20, 2012 in the Lancaster Township Municipal Building. The following members were present: Bob Desmarais, Glenn Ebersole, Richard Hendricks, Melanie LeFevre, Gordon Reed, and Angela Sowers. Also present from Lancaster Township: Tom Daniels, Zoning Officer, Rebecca French, Zoning Assistant, Bill Laudien, Township Manager and Kathy Wasong, Board of Supervisors. Gwen Newell of the Lancaster County Planning Commission was present. Keith Heigel, Light-Heigel & Associates Inc, Donna Deerin Ward, LMS, Caroline Hoffer, Barley Snyder, Eric Mountz, Traffic Planning & Design Inc, Rich Ozimek, Blackford Development, and Mike Leichliter, Superintendent of Penn Manor School District were also in attendance.

APPROVAL OF MINUTES – February 21, 2012

The February 21, 2012 meeting minutes were approved as submitted.

PUBLIC PARTICIPATION/COMMENTS: NONE

SUBDIVISION/LAND DEVELOPMENT PLAN
Action Item: Petition of Blackford Development LTD to amend the Official Zoning Map of the Zoning Ordinance of Lancaster Township.

Review: Caroline Hoffer, attorney with Barley Snyder, stated that Penn Manor School District, has joined to consent and are in agreement with the Petition to the Board of Supervisors of Lancaster Township by Blackford Development to Amend by Rezoning the tract of land, a 1.53 acre parcel located between the West side of Millersville Road (S.R. 741) and the East side of Barbara Street owned by Penn Manor School District and situated in Lancaster Township, Lancaster County, PA, to be changed from Campus Open Space to Composite Commercial, C-2.

The reason for the rezoning request would be to allow for commercial redevelopment of the site. Ms. Hoffer stated her position for the compatibility of this proposed use with the comprehensive plan and stated that the applicant commits to submit an additional rezoning petition to establish the zoning district boundaries on the road centerline once than design has been finalized.

Keith Heigel described the overall project scope

• Rezoning request to propose commercial use in the 5.9 acre triangle area
• Convenience store with 8 lanes of gasoline fueling and parking lot
• Retail stores/parking
• Restaurant/ parking
• Bank with drive through teller/parking
• Extension of Wabank Road and signal improvements
• Driveway through commercial development parking lot
• Entrance lane from SR 741 into driveway
• Full access onto extended Wabank Road
• Pedestrian facilities around perimeter of site
• Pedestrian crosswalks through driveway entrance and exit
• Barbara Street realignment at intersection with extended Wabank Road
• Night time parking lot lights would not shine into residential neighborhoods
• Street trees would be planted
• Landscaping between streets and parking lot
• Stormwater run off through bypass pipe
• Nine rain gardens installed around perimeter of commercial area
• Collect rain water before discharged
• Applicant has agreed to provide Township with fee-in-lieu-of parkland for the area being out of open space.

Several pages of signatures supporting the proposed retail commercial development were submitted to the LTPC from residents at Mill Creek Manor, the Sterling Place Homeowners Association, and from EG Stoltzfus, builder at Southern Village.

Gwen Newell of Lancaster County Planning Commission stated that County Planning Commission staff reviewed the petition for the rezoning request and recommended disapproval of the rezoning; the main issue with the disapproval of the rezone is:
• It does not meet the intent of the County and Township Comprehensive Plan
• It does not allow for a reasonable buffer between the multiple retail uses and proposed collector road expansion and the existing recreational use.

Ms. Newell reiterated that the proposed use of the Campus / Open Space District (S) is to conserve open lands and to provide educational and recreational opportunities for the community.
• It is the intent to provide for such uses where they will be most convenient to the residents and harmonious with the surrounding land uses.
• Permitted uses include in part; schools, parks, playgrounds, public and private swimming pools, and accessory buildings to permitted uses.
Traffic Planning and Design, Inc (TPD) held a meeting on Friday, February 24, 2012 at the Blackford Development offices with the Millersville Borough Manager, Millersville Borough Consultant, Rob Visniski, RAV Associates, Lancaster Township officials, and engineers from Rettew, among other attendees, to discuss the design of the roadway and accommodations for pedestrians related to the traffic impact study.

Eric Mountz of TPD presented updated Concept Plans to the LTPC.

• The limits of the plans were expanded to show the entire length of Wabank Road Extended from its intersection with Millersville Road to the tie in point with existing Barbara Street
• Plans were expanded to show the design of the driveway relocations for the four (4) impacted residential properties along the western side of Barbara Street
• A separate southbound right turn lane was added for vehicles on Millersville Road making a right turn to Wabank Road Extended.
• A 50 ft radius was provided on the southeast corner of the Millersville Road/Wabank Road intersection
• Pedestrian facilities were provided between the proposed ADA ramps on the northeast corner of the Millersville Road/Wabank Road intersection
• The length of the proposed eastbound Wabank Road Extended left turn lane at its intersection with Millersville Road was increased by eliminating the crosshatched gore area.
• Six foot wide pathways would extend along western side of Millersville Rd and southern side of Wabank Road Extended/Barbara Street
• Connect to the existing path along Barbara Street to Crossway Church
• Proposed improvements on Millersville Rd (State Road 741) North toward 999
• Proposed improvements along Wabank Rd South from Martin Elementary School to Comet Field
• Reroute alignment between Wabank Rd to connect with Barbara Street through SR 741
• Provide crosswalk on Barbara St at its STOP-controlled intersection with Wabank Rd
• Widening of the intersections of Millersville Rd and Wabank Rd
• Increase of pedestrian traffic
• Upgrade intersections
• Right and left turning lanes at intersection of Wabank Rd and SR 741
• Pedestrian crosswalks on all four corners of intersection (between school, recreational fields, retirement homes and commercial properties)
• Signage provided for school crossing lanes
• ADA curb ramps
• Pedestrian push buttons & signals

Ben Webber of Rettew attended the TPD meeting and stated that the zoning line as proposed may not accommodate the minimum three hundred (300) foot centerline horizontal radius required by Lancaster Township’s Subdivision and Land Development Ordinance for collector streets. He stated that the area of the re-zoning may need to be revised, and Rettew does not recommend that the proposed Re-zoning line be out of alignment with the centerline of the proposed Wabank Road West.

The result of realigning Barbara Street to a new intersection with itself and with Wabank Road West will eliminate the existing street Right-of-Way and Lot Annexations onto Borough residential lots currently fronting on existing Barbara Street.
• Rettew recommends that these areas of annexation be residential, not commercial. Lancaster Township Zoning Regulation (e.g. Driveways § 1912) are different, depending on the underlying zoning district.

Mr. Webber asked Ms. Hoffer if the applicant would commit to submitting the second rezoning request after preliminary plan approval and before final plan approval. Ms. Hoffer replied that the applicant would agree to that timeline. Mr. Webber asked Ms. Hoffer if the applicant would commit to re-zoning the residential lot “Add-on” parcels to residential rather than commercial, in the second re-zoning request. Ms. Hoffer replied that the applicant would agree to make that adjustment.

• The Township parcel will only be used for parking

• Concern that commercial crossings would be too close to the school
o Examples of existing proximal school/commercial situations were offered
• A lot of work has gone into the proposed commercial project for re-zoning from Campus/Open Space to Composite Commercial C-2

• Have there been any previous recommendations that the LTPC has had to make that were inconsistent with the County and Township Comp Plan?
o Not to anyone’s recollection at this meeting
o The new Comp Plan has been recently updated with the ‘Growing Together’ Plan a few years ago
o There haven’t been many new developments under the new Comp Plan
o Those development plans that were previously addressed by the LTPC were under the old Comp Plan
• The proposed reroute alignment would move Wabank Rd very close to athletic fields
o The athletic field zones would be moved further inside the field
o Netting and fencing would be in place around athletic fields
• If the rezoning request is recommended to be approved and is approved, what happens if this developer does not follow through on this commercial project?
o The zoning for the entire 38 acre property would then be under one commercially (C-2) district
o Another developer may not necessarily commit to the same improvements to the intersections and other enhancements that this developer has
o Lancaster Township has the right to come back and request a change to the zoning

Mr. Webber stated that it may not be a perfect plan but it does provide some solutions to both Millersville Borough and Lancaster Township.

• The developer did a good job of extending the design further than necessary for a re-zoning request
• The majority of the problems can be solved through the Subdivision Land Development Plan process
• The Petition to rezone must be approved by the Lancaster Township Board of Supervisors prior to the approval of any subdivision land development preliminary plan.

Hearing no other comments, Melissa Kelly, Chair, asked the LTPC to entertain a motion regarding the Re-zoning Petition.

Richard Hendricks made a motion to recommend approval of the petition to rezone the 1.53 parcel of land located within Lancaster Township from Campus Open Space to Composite Commercial C-2. Gordon Reed seconded the motion. The number of LTPC members recommending approval was two (2). The number of LTPC members recommending disapproval of the rezone was five (5.)

The LTPC members voting for disapproval cited reasons that included:

1. The inconsistency with the Lancaster County and Lancaster Township Comprehensive Plans as described in the Lancaster County Planning Commission review

2. The intensity of use of the proposed commercial development is not an appropriate use for this area

3. Pedestrian safety concerns for residents and students

The LTPC members voting for approval cited reasons that included:

1. The proposed development would benefit the neighboring community economically and make needed safety improvements at the Wabank Road and Rt. 741 intersection

2. The need for fuel / convenience store availability

3. Support from Penn Manor School District and Mill Creek Manor

The Petition of Blackford Development LTD and the Penn Manor School District to amend the Official Zoning Map of the Zoning Ordinance of Lancaster Township goes before the Board of Supervisors at the April 9, 2012 meeting at 7 pm at the Township meeting room.

Zoning Ordinance Update:
Mr. Daniels stated that he and Ben Webber expect to finalize the revisions by mid-March and have the final draft of the revised Zoning Ordinance ready to distribute at April 17, 2011 meeting.

Ms. Kelly stated that she attended the James Street Investment District’s meeting on March 6th at the Lancaster County Solid Waste Management Authority. The JSID is currently making revisions to bicycle usage along Harrisburg Pike.

Glenn Ebersole asked if there was a Township regulation regarding the parking of a trailer loaded with white rowing sculls on the Township streets. Franklin and Marshall College has been parking a trailer with sculls on Wheatland Avenue. When residents are driving East on Wheatland Avenue and the early morning sun is shining directly in the driver’s eyes, it is difficult to see the trailer with white rowing sculls. Drivers are not expecting such a large trailer to be parked on the street. Mr. Daniels will contact F&M College to see what can be done about this parking obstacle.

Gwen Newell handed out color spreadsheets showing all impervious percentage of land within each zoning district of Lancaster Township.

APPROVAL OF MINUTES – January 17, 2012

SUBDIVISION/LAND DEVELOPMENT PLAN
LTPC #213: Shepherd Family, 1896 Millersville Rd; Preliminary/Final Subdivision Plan Modifications: Jim Boyer of DMAI stated that the Lancaster Township Board of Supervisors reinstated the original Shepherd Family Trust Plan for 1896 Millersville Rd with a few minor changes. Mr. Boyer referenced Rettew’s response letter to the modifications request, which David Miller Associates replied that the project plans and supported documents have formally been revised accordingly. He requested that the LTPC recommend approval of this project.
Glenn Ebersole recommended approval of the LTPC #213 plan with the regard to Rettew’s review letter of the modifications request. Bob Desmarais seconded the motion. Motion carried.

NEW BUSINESS:

Review: Petition of Blackford Development LTD to Amend the Official Zoning Map of the Zoning Ordinance of Lancaster Township
The initial petition submitted to Lancaster Township by Blackford Development LTD to amend the official zoning map of Lancaster Township requested that 1.53 acres of property within Lancaster Township, currently zoned Campus/Open Space District, be amended and rezoned to General Commercial District (C-3.)
UPDATE: Caroline Hoffer, an attorney with Barley Snyder, stated that since the initial petition to rezone was filed, discussions with the Zoning Officer, Tom Daniels, Ben Webber of Rettew, and Blackford Development, have decided that it would be a better fit to rezone to Composite Commercial, C-2 instead of C-3. The permitted Uses are more restricted in C-2 than in C-3. Ms. Hoffer handed out a newly revised petition to amend the rezoning of the 1.53 acres from Campus/Open Space to Composite Commercial, (C-2.) The reason for the rezoning would be to allow for commercial redevelopment of the site.

Discussion ensued:
• Rezoning request to pave way for proposed intense commercial use
o 5.9 acre retail lot
o Large 8 lane gas station and store
o Retail stores
o Restaurants
o Bank with drive through
• Sidewalks along roadways are necessary
• Increase of pedestrian traffic
• Pedestrians have a responsibility to observe traffic
• New road alignment between Wabank Rd and Barbara Street through state road 741
• Widening of the intersection of Millersville Rd and Wabank Rd
• Pedestrian crosswalks on all four corner of intersection
o Between school, recreational fields, retirement homes and commercial properties
• Provide adequate signage for school crossing lanes
• Night time events at Comet Field
o Netting and fencing would be in place around athletic fields
• The intensity of the proposed commercial development causes safety concerns for pedestrians
o Commercial crossings would be close to the school and retirement home
o Concern for pace of pedestrian traffic using crosswalks

Gwen Newell of the Lancaster County Planning Commission stated that the discussion at tonight’s meeting should focus on the “rezoning” and not the proposed commercial development. She stated that County Planning Commission staff reviewed the petition for rezoning from Campus Open Space to the previously C-3, and recommended disapproval of the rezoning. The petition has now been revised to rezone Campus Open Space to Composite Commercial, C-2. The LCPC would need to revisit the revised rezoning petition.

A meeting is scheduled for Friday, February 24, 2012 at 11a.m. with Millersville Boro and Lancaster Township to discuss the design of the roadway and the accommodations for pedestrians related to traffic impact study. Rettew will provide a review letter of this meeting.

The discussion on the petition for the rezoning will continue at the next month’s LTPC meeting on March 20, 2012 at 7 pm.

OLD BUSINESS:
Zoning Ordinance Update:
Mr. Daniels stated that he and Ben Webber have been meeting twice a week to work on the Zoning Ordinance revisions. Mr. Webber stated that they hope to finalize the revisions by mid-March.

ANNOUNCEMENTS:
Tree Program Update: Mr. Daniels spoke with a representative for the Lancaster County Park tree planting program, and obtained several contacts and resources for the proposed Lancaster Township tree program. A knowledgeable tree representative needs to be in place in order to proceed with the Township’s tree program.

Melissa Kelly announced that she and Bob Desmarais met with Lisa Riggs, President of the James Street Improvement District, (JSID) Shelby Nauman, Program Director, and Marshall Snively, Vice President of the JSID. The JSID is putting together a draft which will address pedestrian and bicycle improvements within the right-of-way along Harrisburg Pike. The JSID is also looking into off trail connections which would be walking trails, not paved sidewalks, to get from Buchanan Park out to Longs Park. They have some funding for this and are looking to increase the funding for this endeavor.

The JSID is having a public meeting on Tuesday March 6th at 6:30 PM at the Lancaster County Solid Waste Management Authority (1299 Harrisburg Pike.) Any planning commission members who are interested are encouraged to attend this meeting.

Ms Kelly also stated that this Thursday, March 23, 2012 at 6:30 to 8:30 pm the Coalition for Smart Growth is holding a Public Forum at the Lancaster County Emergency Management Training Center regarding Form-based codes use. The panel will share their thoughts on the benefits and challenges of developing and implementing form-based codes.

MEETING MINUTES – January 17, 2012

CALL TO ORDER
Melissa Kelly, Chair, called to order the regular meeting of the Lancaster Township Planning Commission at 7:00 p.m. on January 17, 2012 in the Lancaster Township Municipal Building. The following members were present: Glenn Ebersole, Richard Hendricks, Melanie LeFevre, and Gordon Reed. Bob Desmarais and Angela Sowers were excused. Also present: Tom Daniels, Zoning Officer, Rebecca French, Zoning Assistant, Ben Webber, Rettew Engineer, and Gwen Newell, Lancaster County Planning Commission. Steve Gergely of Harbor Engineering and Harry N Snavely of the School District of Lancaster were also present.

ELECTION OF OFFICERS
After a brief discussion, Glenn Ebersole made a motion to re-elect the same 2011 LTPC officers. Richard Hendricks seconded the motion. Motion carried. The 2012 LTPC officers are: Melissa Kelly, Chair, Melanie LeFevre, Vice Chair, and Bob Desmarais, Secretary.

APPROVAL OF MINUTES: December 20, 2011
The December 20, 2011 meeting minutes were approved per corrections within the last paragraph, Street Tree Discussion.

PUBLIC PARTICIPATION/COMMENTS – None

Subdivision/Land Development Plan – Action Items
LTPC #239: School District of Lancaster: Martin Elementary Preliminary/Final Land Development and Lot Add-on Plan

The LTPC reviewed Rettew’s January 4, 2012 letter in response to the requested modifications of the Ordinance’s Design Standards and took action on the following:

Section 305 – Preliminary Plan Processing; Applicant requested modification of the requirement to process a preliminary plan and proceed directly to final plan, include all requirements for the preliminary plan based on:
• The plan is not proposing any new public streets or utility main extensions
• The submitted plan addresses the requirements of both the Preliminary and Final Plan requirements as outlined in the Ordinance
• The existing school will remain in operation while the new school is being constructed, therefore the project can be considered a single phase
Glenn Ebersole made a motion to recommend approval of this modification request and Richard Hendricks seconded the motion. Motion carried.

Section 402.02.A – Plan Scale
The applicant requested a modification of the requirement to provide a plan at a scale not to exceed one (1) inch equals fifty (50) feet, and instead provide a plan scale of one (1) inch equals sixty (60) feet for the existing conditions and demolition plan sheets, justifiable that 60 scale allows all information to be provided legibly on a single plan sheet. Richard Hendricks made a motion to recommend approval this Plan Scale modification and Glenn Ebersole seconded the motion. Motion carried.

Millersville Road
Sections 603.02.B, 603.02.E – Sidewalks
Section 603.03.A, 603.03.B – Curbs
Improvement of Curbing and Sidewalks: Applicant requested modification of the requirement to provide curbing and sidewalks along Millersville Road:

603.03. A & 603.03.B – Curbs:
Per Rettew’s recommendation, conditioned on the provision of curbing from the start of any tapers for widening and through the radius at the intersection of Wabank Road; Richard Hendricks made the motion to recommend approval of the curb modification request and Melanie LeFevre seconded the motion. Motion carried.

Sections 603.02.B & 603.02.E – Sidewalks
Per Rettew’s recommended approval based on the justification and alternative provided of the sidewalk modification, 603.02.B – requesting the use of bituminous materials for sidewalks in some areas, in lieu of concrete; and 603.02.E – applicant states that the proposed location of the sidewalks outside of the right-of-way will be safer for pedestrians; Glenn Ebersole made a motion to recommend approval of the sidewalks modifications, and Richard Hendricks seconded the motion. Motion carried.

Wabank Rd
Applicant requested the following modifications:
• Modification of the requirement to widen Wabank Rd to Township standards
Rettew recommended approval of the modification request with the condition that the Township continue to provide input and ongoing discussions regarding improvements
• Requested the use of bituminous materials for sidewalks in some areas, in lieu of concrete
• Applicant states that the proposed location of the sidewalks outside of the right-of-way will be safer for pedestrians.
Per Rettew’s recommendation to approve of the modification request based on the justification and the alternative provided; Richard Hendricks made a motion to recommend approval of the sidewalk modifications and Glenn Ebersole seconded the motion. Motion carried.

Ben Webber stated that they are working with Southern Village to amend their plan and provide a connection to the sidewalk located on the adjacent Southern Village property.

Section 602.2.F – Access Drive Horizontal Alignment
Applicant requested a modification of the requirement to provide a minimum one hundred fifty (150) foot centerline radius at the easternmost access drive to Wabank Rd, and in the alternative provide a centerline radius of fifty-two (52) feet near the access drive’s intersection with Wabank Rd based on the justification that the reduced radius is necessary to connect the existing drive and adjacent bus storage facility.
Per Rettew’s recommendation to approve this modification based on the justification provided, with the condition that a stop sign is provided on the northbound approach of the access drive where it meets the bus facility parking lot and that the layout of this intersection is revised to prevent vehicles backing out of parking spaces into the access drive cartway; Glenn Ebersole made a motion to recommend approval of this modification and Richard Hendricks seconded the motion. Motion carried.

Sections 603.03.A, 603.03.B – Curbs
Applicant requested a modification of the requirement to provide curbing along the access drives and parking compounds, based on there being no need for curbing in all areas of the parking lots and access drives for pedestrian safety, grade changes, or storm water runoff. The storm sewer system would be less expensive and snow removal would be easier.
Per Rettew’s recommended approval of this modification for areas within the site where pedestrian facilities are not located adjacent to the access drive; Melanie LeFevre made a motion to recommend approval of this modification and Glenn Ebersole seconded the motion. Motion carried.

Section 608.01.D.4 – Inlet Construction
Applicant requested a modification of the requirement to provide an inlet satisfying the PennDOT standard of 24” x 48” for the proposed yard inlet located within the building courtyard and in the alternative, provide a 24” x 24” inlet, based on the justification that the inlet will not be subjected to traffic loading due to its location, that the proposed inlet receives a limited drainage area which is accommodated by the smaller inlet, and that the smaller inlet grates are more conducive to foot traffic. Per Rettew’s recommendation, Richard Hendricks made a motion to recommend approval of this modification and Glenn Ebersole seconded the motion. Motion carried.

Section 608.01.H.2.a – Minimum Depth of Infiltration Facility
Applicant requested a modification of the requirement to provide a minimum depth of forty-eight (48) inches between the bottom of the infiltration facilities and the seasonal high water table and/or bedrock and, in the alternative, provide approximately twenty-four (24) inches of separation; based on the justification that the PA Storm Water BMP Manual allows for two (2) foot separation, the facilities will be privately owned and maintained in design condition, the
facilities are in a public water service area and will not affect any wells utilized for consumption, and due to the depth of bedrock on the site, allowing the facilities to be installed
less than forty-eight (48) inches from the limiting zone will allow the site to achieve the required Ordinance groundwater recharge standards and partially achieve the required NPDES permit infiltration volume. Per Rettew’s recommendation, based on the justification provided, Richard Hendricks made a motion to recommend approval of the modification and Glenn Ebersole seconded the motion. Motion carried.

The LTPC recommended approval of the Martin Elementary School (Wabank Road and Millersville Pike) Preliminary/Final Land Development and Lot Add-On Plan pending the condition of the applicant’s satisfying the comments of Rettew’s January 4, 2012 letter.

OLD BUSINESS

Southern Village – Side Yard Separation Issues
Tom Daniels stated that a meeting was held with the developers of Southern Village, EG Stoltzfus, Mike Pickard, the Emergency Management Coordinator, Bill Swiernik, of DMA, Bill Laudien, Twp Manager, and himself regarding the building side yard separation issues. They discussed installing sprinkler systems within the buildings and fire ratings on the walls of the buildings if an agreement could be met regarding the side yard separation issues. The developer has not contacted Mr. Daniels at this time.

Street Tree Discussion
The city arborist, Jim Bowers, contacted Bill Laudien and stated that he will not be able to help Lancaster Township implement a street tree planting program. The Township’s Superintendent of Public Works, Angel Saldana, is looking into other resources.

Update: Revised Zoning Ordinance
Mr. Daniels and Mr. Laudien are meeting once a week with Ben Webber, regarding Rettew’s review letter of the revisions to Lancaster Township’s Zoning Ordinance.

NEW BUSINESS

Mr. Daniels stated that the Board of Supervisor’s have reinstated a Subdivision Land Development Plan that was previously submitted in 2006, by Shepherd Family Limited Partnership. The project name is now called of 1896 Millersville Road. This Final Subdivision and Land Development Plan (Revised) will be on the Agenda for February 21, 2012 meeting.
